I did love that argument. When my highschool got a new principal, the smokers said the same thing. They should be allowed to smoke on school property because, “Hell, I’ve been here longer than she has!” Some how, I fail to see the logic. A few decades ago it was legal to drink beer while driving in Texas. You still couldn’t be drunk, but the was no “open container” law. I’ve never heard of some 80 year old trying to get his ticket dismissed because he was drinking and driving before it was illegal.
